Standard Terms and Conditions

1. Definitions & Interpretation

  1. Agreement” refers to these Terms and Conditions, including any additional schedules or service agreements.

  2. Australian Consumer Law” refers to Schedule 2 of the Competition and Consumer Act 2010 (Cth).

  3. Customer” refers to any individual or entity engaging Go Zero Waste for services.

  4. Services” refers to the waste management services provided by Go Zero Waste.

  5. Equipment” refers to any bins or waste collection tools provided by Go Zero Waste.

  6. Unauthorised Waste” refers to any waste prohibited under these Terms.

  7. We“, “Our“, “Us” refers to Go Zero Waste.

  8. You“, “Your” refers to the Customer.

  9. Break Fee” refers to a charge incurred when terminating a contract early, calculated as 20% of the average monthly charge multiplied by the remaining months in the term, plus any outstanding equipment and service costs.

2. Services

  1. Go Zero Waste provides exclusive waste management services at the premises agreed upon in the service contract.

  2. Scheduled collections are carried out as agreed; additional collections may incur extra charges.

  3. Weekend and public holiday collections may attract surcharge fees.

  4. Service may be suspended if payment terms are not met.

  5. A futile fee may apply if access is restricted, preventing waste collection.

  6. If the Customer relocates premises, the contract remains valid, and service charges may be adjusted accordingly.

3. Contract Term & Termination

  1. Services are provided for the agreed-upon term, with automatic annual renewal unless canceled with 30 days’ written notice.
  2. Go Zero Waste reserves the right to terminate services if payments are overdue or contractual obligations are breached.
  3. Early termination fees (Break Fee) may apply, calculated as 20% of the average monthly charge multiplied by the remaining months in the term, plus any outstanding equipment and service costs.

4. Payment Terms

  1. Invoices are payable within the agreed timeframe, typically seven (7) days from the end of the month.

  2. Late payments incur a $20+GST fee plus an additional 0.5% daily charge on overdue amounts.

  3. Customers must maintain a minimum spend as specified in their service agreement.

  4. Additional charges may apply for overfilled or contaminated bins.

  5. Fee adjustments may occur due to changes in disposal rates, CPI, or regulatory changes, with 30 days’ notice.

5. Equipment Usage

  1. Equipment remains the property of Go Zero Waste and must be used as intended.

  2. Customers are responsible for maintaining the cleanliness and security of the equipment.

  3. Removal of equipment at contract termination incurs a $250 removal fee.

  4. Damaged or lost equipment may result in additional fees.

  5. Customers may be required to provide a security deposit for high-value rental equipment.

  6. Equipment insurance may be required for rentals exceeding $150,000 in value.

6. Waste Management & Compliance

  1. Only permitted waste should be disposed of in designated bins.

  2. Contaminated or unauthorised waste may result in additional charges or refusal of collection.

  3. Customers must ensure proper storage and segregation of waste.

  4. Go Zero Waste reserves the right to reject hazardous, medical, or non-compliant waste.

  5. If unauthorised waste is placed in the bins, the Customer is responsible for additional disposal costs.

7. Liability & Indemnity

  1. Customers are responsible for the safety of individuals accessing waste collection areas.

  2. Go Zero Waste is not liable for any indirect, consequential, or economic losses.

  3. Liability for service failure is limited to re-performing the service or refunding the relevant portion of fees paid.

  4. Customers indemnify Go Zero Waste against claims arising from non-compliant waste disposal or improper use of equipment.

8. Consumer & Small Business Rights

  1. Nothing in these terms limits consumer rights under the Australian Consumer Law.

  2. Small businesses may request a review of fee adjustments within 30 days of notification.

  3. Customers may terminate services within 30 days if annual fee increases exceed 5%.

9. General Provisions

  1. These terms are governed by the laws of Victoria, Australia.

  2. Force Majeure: Go Zero Waste is not liable for service failures due to events beyond reasonable control.

  3. Changes to these Terms may occur, with notice provided to Customers where required.

  4. Electronic signatures and communications are deemed legally binding.
